Terms and Conditions of Hire

The hired item(s) are hereinafter referred to as the Plant

The Party Crew Limited, is the Owner or Bailee of the Plant & is hereinafter referred to as the Owner.

1. Responsibilities of Persons Accepting

The person accepting the contract, warrants that he/she has the authority of the Hirer to make this contract on the Hirer’s behalf. The said person hereby indemnifies the Owner against all losses and costs that may be incurred by the Owner if this is not so. When a booking is confirmed via email it shall be deemed that the recipient of the booking confirmation email shall have accepted terms and conditions of hire here stated.

The said person hereby acknowledges that he/she has been instructed in the operation and use of the Plant. The said person and the Hirer jointly and severally hereby undertake to ensure that:

· No one uses the Plant who is not properly instructed and shall not allow the Plant to be misused.

· They will undertake full responsibility for the safety of the Plant on hire, and will accept full responsibility for the loss or damage of said equipment, howsoever caused.

· The Plant is used for the purpose for which they were designed.

· They will not part with possession of any of the said Plant or item thereof.

· They will not erect, move or dismantle any of the Plant unless specifically instructed to do so by the Owner.

· They will immediately on request advise the owner of the whereabouts of the Plant.

· They will not pledge the Plant or any item thereof nor allow the same to be taken in execution.

· No pets or smoking will be allowed on/directly near any of the Plant.

· No silly string, streamers, food or drink of any kind will be allowed on /directly near any of the Plant.

· Access to the area & the area itself is free of litter, rubbish and animal foul.

· The area is free from any sharp objects / stones / branches etc that may puncture the Plant.

· If required, a13amp electricity supply is available to within 5 metres of each piece of the Plant.

· No BBQ’s, Patio Heater’s or any other form of heat source will be allowed on /directly near any of the Plant.

· They will not interfere with or allow any other person to interfere with the mechanism or other parts of the equipment on hire without the express permission of the owner and shall indemnify the owner against any claims, loss or damage suffered by any party (including any third party) as a result or in consequence of any interference.

2. Delivery in Good Order / Returns in Good Order

The person signing the contract / accepting a booking confirmation email acknowledges having been afforded an opportunity to inspect the Plant, and is hereby deemed to be in good working order and wholly free from any defect and/or damaged at the time of delivery. Also to maintain the Plant in the same good working order, condition, appearance and state of repair as they were are on receipt of said goods, in default of doing so, hereby agree to pay the owner on demand the cost of putting the same in such condition appearance and state of repair howsoever any damage may be caused.

By agreeing to our terms and conditions of hire, you accept that occasional unforeseen circumstances occur whereby we are not able to deliver the exact piece of equipment you have specified. (E.G. Bad weather causing wet/damage on the previous hire or accidental damage caused to a piece of equipment without time to order in replacements or make repairs.) In these circumstances we will offer an alternative piece of equipment of the same or higher value and will also compensate you by adding an additional item free of charge.

3. Hirer’s Responsibility – Third Party

The Hirer shall at all times and in all respects indemnify the Owner against and from, any and every expense liability, loss, claim or proceeding whatsoever in respect of any personal injury whatsoever (including but without prejudice to the generality of the foregoing, injury to the Hirer (if the same is possible) and injury in respect of damage to any property whatsoever (including the Plant) arising out of or in connection with or consequent upon the hire, delivery, use, misuse, non-use, repossession, collection, return or non-return of the Plant or any part thereof.

What are my (the hirers) responsibilities? You are responsible for the security of the equipment for the duration of the hire, provision of a safe electricity supply, safe operation of the equipment as per our "Operating Instructions" and Constant Adult Supervision. If you feel that you are unable to provide constant adult supervision then, given sufficient notice (normally minimum 7 days notice and subject to staffing availability) we can provide supervision for you (this is a chargeable service - please contact us for more details).

4. Lost, Non-Returned, Damaged or Unclean Plant

When the Plant is reported lost or is not returned when the termination of the hire is requested by the Owner, the hire will be deemed to end when the Hirer pays to the Owner the manufacturer’s current price list of all Plant signed for. The Hirer agrees to pay the Owner on demand all costs incurred by the Owner in rectifying the condition of the Plant returned damaged or unclean howsoever any damage may be caused. Hire charges will continue until such rectification is complete. When, at the termination of the hire the Plant is found to be dirty, the Owner shall be entitled to charge the Hirer, and the Hirer hereby agrees to pay to the Owner on demand, a cleaning fee of minimum £50.00.

5. Overnight Hire / Wet Weather

Inflatables / Bouncy Castles. If it rains during use / hire period & the equipment is supplied with a sewn in rain cover the Hirer hereby agrees to:

· Keep the castle inflated so as to allow water to run off the castle and not pool inside but not to allow anyone to use it until safe to do so.

· Store all safety mats in a secure, dry area.

· For an overnight hire the hirer agrees to deflate the equipment and fold it in half so as to allow the base of the equipment to become a protective cover allowing any rain to run off the equipment and not pool inside.

The Hirer hereby agrees to pay the Owner on demand any and all costs incurred by the Owner in rectifying the condition of the Plant returned wet or damaged due to the Plant being used / left uncovered / not correctly folded over night.

6. Termination of Hire

The Owner shall be entitled at any time and for any reason whatsoever, without explanation, to terminate this contract (such termination to be effective immediately) and to repossess the Plant or any part thereof.

7. Deposits & Payment for Hire of Plant

Please note that all invoices should be settled 24 hours before booking date. Failure to settle your invoice in full, may result in a 10% late charge being applied to your bill.

When making a booking, the Owner may request, and the Hirer hereby agrees to pay the Owner a booking deposit of part of or the full amount of the hire cost. No hire will commence until receipt of full payment of deposit is paid. The deposit will be refunded provided that all hired Plant is checked on collection by the Owner and found to be in the same condition as it was when erected.

Payment for hire of Plant must be received in full prior to the set up of the Plant. No hire will commence until receipt of full payment is received.

8. Cancellation Terms

For Bouncy Castles you can cancel at anytime up to 24hours before your party date but we ask that you give us as much notice as possible so that we can hire out your castle to someone else. Please note that a 10% admin fee will be retained for any cancellations on all bookings if a refund if requested. If no notice is given you may incur a 100% cancellation fee (ie cancellation on the day for any reason other than bad weather conditions or if we are on our way or have arrived at the destination.) For large equipment such as the Swingboats etc we have a more formal cancellation policy. Because the equipment requires a lot of set up etc and there are only limited dates for it's use we reserve the right to charge cancellation fees based on the length of time until the party start date as follows: Up to 1 month - 85%. Up to 2 weeks - 90%. Up to Up to 1 week - 95%. Less than 1 week: 100%. It is strongly recommended that the Hirer takes out Event Insurance to cover cancellation charges.

9. Postponement

We will try and be as flexible as possible, so if you need to postpone your event to another mutually convenient date due to severe weather conditions then, provided that we have not incurred any labour, set up or other charges, no penalty fees will be charged.

This agreement shall determine forthwith without prejudice to any antecedent claim to the owner and the goods may forthwith be repossessed by the owner in any one or more of the following events:

(a) the commission of the hirer of an act of bankruptcy or his entry into any agreement with his general body of creditors.

(b) The breach by the hirer of any of the stipulation herein contained and on his part to be observed and performed.

10. Rights of Access

The Hirer hereby authorises the Owner (upon production of this document) to enter any premises wherein the Owner reasonably believes any Plant, or any part thereof to be, ad if, and in so far as, the Owner in his absolute discretion deems necessary, to inspect, test, repair, replace or repossess the same.

Law

All contracts and all rights, and obligations of the parties shall be governed by Jersey Law and the parties hereby submit to the exclusive jurisdiction of the Courts of the Bailiwick of Jersey

BOUNCY CASTLES

It is the responsibility of the person who is hiring this Bouncing Castle to ensure that all possible steps are taken to avoid injury or damage to the Inflatable. Please ensure that the following Safety Instructions are followed:

  1. 1. Children's Bouncy Castles have an age limit of 11 years old (NO ADULTS). Please ensure no one over this age uses the equipment. No adults are to use children's Bouncy Castles. If we know that this limit has been exceeded we will need to send the castle off for safety testing and the cost of any repair, if needed will be levied onto the customer. The deposit will be lost.
    NB. The toddler castles can be used up to 5 years old ONLY.
    Please ensure that the inflatable is kept in a clean condition – if we have to take the castle away to clean before the next hire, then the deposit money will be used to cover the cost of it being laundered.
  1. No food or drinks or chewing gum to be allowed on or near the Bouncy Castle which will avoid choking and mess (Please note if the Inflatable is collected in a dirty condition then the person hiring it will incur a cleaning charge)
  2. All shoes, glasses, jewellery, badges MUST be removed before using the Bouncy Castle.
  3. No face paints, party poppers, coloured streamers or silly string to be used either on or near the Bouncy Castle.
  4. No smoking or BBQ’S near the Bouncy Castle.
  5. Climbing, hanging or sitting on walls is DANGEROUS and must not be allowed.
  6. A responsible Adult must supervise the Bouncy Castle at all times.
  7. Always ensure that the Bouncy Castle is not overcrowded, and limit numbers according to the age and size of Children using it. Try to avoid large and small Children from using it at the same time.
  8. Children are not pushing, colliding, fighting or behaving in a manner likely to injure or cause distress to others.
  9. If the Bouncy Castle is not being used for any part of the day, please switch the blower off at the mains.
  10. Do not allow anyone to bounce on the front safety step as a Child could easily bounce off the inflatable and get hurt. The step is there to assist users in getting on or off!
  11. Ensure that no one with a history of back or neck problems is allowed on the Bouncy Castle as indeed any Child who is feeling unwell.
  12. Do not allow anyone to be on the Bouncy Castle during inflation or deflation as this is dangerous.
  13. No pets, toys or sharp instruments to be allowed on or near the Bouncy Castle.
  14. Please ensure that Children are not attempting somersaults and are clothed appropriately and that nothing can fall out of their pockets.
  15. Ensure that an area of 6 feet (2 metres) around the unit is completely clear
  16. For your safety the Bouncy Castle should not be used in wet weather. In the event of rain, the unit should not be used - the castle should be turned off and the electric blower and any extension should be disconnected and brought in out of the rain. The Bouncy Castle MUST be folded & completely covered with a tarpaulin.
  17. In the event that the blower stops working, please ensure all users get off the inflatable immediately. The blower has a safety reset button, try pressing this, also check the fuses and make sure the blower tube or deflation tube has not come undone or something has not blown onto and is obstructing the blower. In the event that it overheats, or loses power, switch the blower off at the mains, then switch it back on again 1 or 2 minutes later, and it should restart. If it does not, inform us straight away.
  18. In the event of unsuitable weather, the full fee will still be payable for services and entertainments provided.
  19. Cancellation terms apply once a booking has been accepted, either verbally or in writing. The Party Crew Limited cancellation terms apply and take preference over any such terms in client’s standard terms. Unless otherwise indicated, for cancellations more than one month, 25% or contract value and for cancellations within one month 100%
  20. The Party Crew Limited will only operate within accepted standards of Health & Safety and our staff on site reserve the right to refuse to provide services that contravene those standards or the terms of our insurance.

Please ensure there is a minimum of 3 feet clear access to where the inflatable is going, and you must notify us if there are any stairs to negotiate. Failure to notify us of this could result in the cancellation of your equipment hire and the cancellation fee applicable.

Disclaimer

Please note that all persons using this Bouncy Castle do so at their own risk.

The person/s or organisation hiring this Inflatable equipment will be responsible/liable for any damage or injury occurring from or as a result of misuse or reckless use.

These guidelines are for the safety of all people using this equipment, and it is the sole responsibility of the hirer to ensure they are fully adhered to at all times.

Our Company cannot, does not and will not accept any responsibility for any injury caused to anyone using our equipment.

I have read the above agreement and fully understand and accept the conditions as above. I am aware that whilst in my care I am fully responsible for the inflatable and will pay for any loss or damage that may occur, this will include the inflatable being returned in an unacceptable condition, i.e. if it is in a dirty or muddy condition, I will be expected to pay an additional cleaning charge.

SUMO WRESTLING

The official object of this game of Japanese wrestling is to either push, pull, trip, or throw your opponent out of the coloured circle on the thick padded, mat, or force them onto their back. Helmets in the shape of a Sumo hairstyle are compulsory. 'Splatting' your fallen opponent is usual Super Sumo etiquette. Comes complete with suits, mat, helmet and neck braces.

Sumo Suit Hire Agreement & Disclaimer - Please read before hire

Sumo Wrestling Suit Hire Agreement.

When used correctly the sumo suits can be hilarious fun, but if used incorrectly they represent a serious risk of injury or even death to anybody using them. Please ensure there is ten feet of space all around the mat. The Party Crew Limited will not take responsibility for any accident happening as a result of there not being enough room around the mat.

Your safety is paramount, in order for you to get the most fun and enjoyment from our equipment please observe these instructions. If there is anything you don't understand or are unsure of please don't hesitate to ask.

Make sure all the protection supplied is being worn. The wrestling mats are not wrestling mats they are Sumo Wrestling Mats, to be used with all of the Sumo Suit equipment and this equipment only.

Make sure that the helmet is being worn and is securely fitted onto the users head, not too tight so as to choke, but it shouldn't be loose or able to move around freely, it should be secure. Make sure the neck brace is being worn, as above this should be securely fitted but not overly tight or loose.

The Sumo Suit body is a 'one size fits all'. This must be worn at all times.

The Sumo Wrestling Mat should have plenty of clear space all around, at least 10ft but preferably a lot more. Spectators should be kept a similar distance away. When wrestlers fall they can easily fall or roll off the mat.

The wrestling event should be supervised by two responsible adults at all times. If anybody refuses to wear the required safety equipment, then they can't wrestle.

You are fully responsible as the hirer for both the equipment and the participant, if it isn't supervised for any amount of time then it should be shut down and no one allowed to use it until it can be supervised again!

Ensure there is adequate First Aid equipment available before using the equipment. The Sumo Suits must be returned in an acceptable condition, i.e. clean, unspoiled and undamaged.

No eating, drinking, shoes, glasses, jewellry, buckles, key-rings, metal-studded clothing, pets, silly string, toys or other sharp instruments or similar items which could cause injury or damage allowed on the sumo equipment at any time.

Remember, these are hired for fun, do not be overly aggressive or enthusiastic, hitting somebody excessively hard or body slamming them is not advised, this won't improve your experience using them but may hurt somebody quite seriously. The idea of the game is to force your opponent onto the floor or out of the circle, not to beat or crush them as hard as you can.

Sumo Wrestling Suit Disclaimer

The Party Crew will not be held liable in any way for any injury or damage caused whilst using these Sumo Wrestling Suits which may result in injury, death or any other loss or damages to me or anyone using the equipment while under my control.

I personally accept all responsibility in connection with the Sumo Wrestling Suits, for any harm, injury, loss or damage including all associated risk that may occur while I am hosting, controlling and or participating in this event. I further state that I am over the age of 18 and legally competent to sign this agreement.

It is my intention with this signature to exempt The Party Crew Limited from all liability whatsoever for personal injury, property damage or death caused whilst using this equipment. I acknowledge that I have read and understood this agreement before signing it. I verify that I understand the nature of the activities involved. I will ensure that all people using this equipment are physically fit, and able to participate in the event.
